Board OKs Civil Action Complaint Against Contractor

The Bensalem Township School Board is seeking monetary damages and a fix related to what a district characterized as faulty HVAC work.

The Bensalem Township School Board is taking steps to have a contractor remediate HVAC work because units are not "functioning properly," according to a district official.

The board on Tuesday night, at the suggestion of attorney, Thomas J. Profy III, voted to permit the filing of a civil action complaint against B & S Sheet Metal related to HVAC and mechanical work that the company carried out in the high school's gymnasium.

Profy told Patch after the meeting that the board's action resulted from "the failure of the contractor to complete all aspects of the HVAC system."

As a result, Profy said there is a need for "remedial work" to prevent the units from leaking water, as is the case now.

Monetary damages will be sought as well, he said.

Profy said he could not recall how much the district paid for the HVAC and mechanical work.
