Federal Grand Jury Indicts Montco Man On Child Pornography Charges

TOWAMENCIN TOWNSHIP, PA — A Montgomery County man has been indicted by a federal grand jury on child pornography charges.

Matthew Aubin, 44, of Staley Circle in Harleysville, a registered sex offender who was facing similar pending charges in state court, was transferred to the custody of the federal government after the grand jury indictment.

A report in North Penn Now says that Aubin was previously convicted on child pornography charges back in the spring of 2012, and that he has had to register as a sex offender since December of that year.

State court records show that following a stand-by trial earlier this month, the 75 criminal charges that had been lodged against Aubin in state court with withdraw, as the case was transferred over to the jurisdiction of the feds.

According to the federal indictment, Aubin knowingly received and attempted to receive child pornographic imagery that was sexually explicit in nature.

Alleged incidents occurred in December 2020 and February 2021, according to the indictment.

The charging document says that Aubin's phone contained the child porn images, which were depictions of minors engaged in sexually explicit conduct.

Records from the federal courthouse in Philadelphia show that the indictment was filed in early July.

The court docket in the case shows an arrest warrant for Aubin was filed on July 13, after which a federal magistrate judge ordered that the warden of the Montgomery County Correctional Facility to transfer Aubin over to U.S. Marshals and bring him in to answer to the indictment.

The order was issued by U.S. Magistrate Judge Lynne A. Sitarski.

A detention hearing was subsequently scheduled for July 19, during which Aubin entered a not guilty plea on all counts, and stipulated to pre-trial detention, according to the federal court docket.

Court records show that a jury trial has been scheduled to take place on Sept. 7 before U.S. District Judge Mitchell S. Goldberg.
