Teen Sex Assault Lands Montco Man State Prison Term

LOWER MORELAND TOWNSHIP, PA — A 22-year-old Montgomery County man will be heading to a state correctional institution after he admitted to sexually assaulting a then-13-year-old girl.

Tabias Javah Davis-Diaz, of the Huntingdon Valley section of Lower Moreland Township, drew a prison term this month after he was sentenced by Montgomery County Common Pleas Court Judge Risa Vetri Ferman following his guilty plea in connection with the sexual assaults that occurred two years ago when he was 20 years old.

Court records in the case show that Ferman on Nov. 15 sentenced Davis-Diaz to 2 to 10 years in state prison after the defendant pleaded guilty to two felony counts of statutory sexual assault and corruption of minors and one misdemeanor count of indecent assault of a person less than 16 years of age.

Ferman also gave Davis-Diaz five years of probation to round out his sentence.

According to a report in the Mercury newspaper, Lower Moreland Township investigators had received a report about the sexual assault in early October 2020 after the victim said there was sexual contact between her and Davis-Diaz when she was in town visiting from out of state.

The victim reportedly knew Davis-Diaz's family and the sexual assaults were said to have occurred on two separate occasions when the girl was in the company of the defendant.

The criminal docket sheet in the case shows that in addition to the prison sentence, Ferman also ordered Davis-Diaz to comply with Megan's Law sex offender registration requirements for a 25-year-period.

The Mercury reported that Ferman also ordered Davis-Diaz to undergo a psychosexual evaluation and comply with recommended treatment options and that he must also participate in a sex offender treatment program while behind bars and also participate in a community-based sex offender treatment program after he is released from prison.

The defendant is not allowed to have any further contact with the victim or her family.
