A 24-year-old Exton man is facing multiple charges after he allegedly urinated in a trash can at Wawa on Trooper Road after discovering that the bathroom was undergoing renovations.
Lower Providence Police responded to the scene at 3:13 a.m. on the morning of May 25, where they found the man – identified as Brendan Joseph Herbetko, 24, of Exton – in the passenger seat of a white Acura being driven by a local female. The report states that police initiated a traffic stop in the Wawa parking lot, at which time the driver immediately began to apologize for her boyfriends behavior.
Herbetko reportedly showed signs of intoxication, and had to be asked for his license several times before handing it over to police, the report states.

An employee informed police that Herbetko did not disturb any of the employees or customers, but he was caught urinating in a trash can after he found out that the bathroom was being remodeled, according to the report.
Police then returned to the vehicle to speak to the driver, when they reportedly smalled alcohol on her breath. The report states the driver was given a breath test, which showed her sample as being "just over the legal limit." Police allowed the driver to contact her friend to come and pick up the vehicle, at which point Herbetko repeatedly tried to exit the vehicle, the report states.

As police were gathering Herbetko's information so they could mail him a disorderly conduct citation, he repeatedly tried to exit the vehicle, requiring police to push him back inside, according to the report. Despite the repeated orders, Herbetko again tried to exit the vehicle, at which point he was handcuffed and taken into custody for public drunkenness, police said.
A small bag of marijuana was allegedly found in the breast pocket of his shirt, according to the report.
Herbetko was arraigned before District Justice Juanita Price on charges of possession of a small amount of marijuana, public drunkenness and disorderly conduct. Despite requests from police that Herbetko be released on his own recognizance, Judge Price set bail at 10-percent of $10,000 and he was remanded to the Montgomery County Correctional Facility after failing to post.
