Philly Man Pleads Guilty To Raping Upper Moreland Woman In March 2020

UPPER MORELAND, PA — A Philadelphia man has pleaded guilty to sexually assaulting his former girlfriend when he broke into the woman's Upper Moreland home last year and raped her, telling her he planned to "impregnate her."
Brian David Kelly, Jr., 36, entered an open guilty plea to a count of rape by forcible compulsion, a first-degree felony, in connection with criminal charges he was facing following the sexual assault that occurred back on May 18, 2020, according to a criminal docket sheet in the case.
Court records show that Kelly had initially been charged a whole host of other felonies and misdemeanors stemming from the assault, which Montgomery County prosecutors said occurred after Kelly's ex-girlfriend had broken up with him following two years of courtship.

At the time he was charged in March 2020, Kelly had continued to call and text his former girlfriend despite the relationship being over, the Montgomery County District Attorney's Office previously stated.
According to the D.A.'s office, Kelly had used a ladder to climb to the roof of the woman's home on the day of the assault and proceed to enter the house via balcony door. Once inside, he raped the woman, despite the victim telling Kelly "no" more than 40 times, according to prosecutors.

During the assault, Kelly told the woman that he planned to "impregnate her," according to the D.A.'s office.
Sentencing in the case is currently scheduled for January 2022, according to court records. The docket sheet shows that Montgomery County Common Pleas Court Judge Thomas C. Branca has ordered a presentencing investigation on Kelly, who will be required to undergo a psychosexual evaluation prior to sentencing.
The Pottstown Mercury reported that Kelly faces a possible sentence of between 10 to 20 years in state prison, although sentencing guidelines could allow for a lesser sentence.
