Bam Margera's Assault Trial Date Set In Chester County Court

Margera's trial on assault charges has been delayed to provide the former MTV star time to work on his sobriety.

WEST CHESTER, PA —Brandon “Bam” Margera, former star of MTV’s “Jackass,” is scheduled for trial on Nov. 15 in the Chester County Justice Center.

Margera, 44, is accused of assaulting his older brother, Jesse, 45, in the family residence, known as "Castle Bam" Pocopson Township, Chester County.

The trial has been delayed following an Aug. 24 court order by Judge Patrick Carmody, which required Margera to work on his sobriety, stay in the Philadelphia area, and wear an alcohol detection bracelet on his ankle.

Subsequently, Carmody on Sept. 28 allowed Margera to leave Pennsylvania to work at a biannual horror convention in Tampa, Fla., with other celebrities.

This past weekend, Margera signed autographs at the Atlantic City HorrorCon and Film Festival at the Showboat Casino last weekend.

Margera's lawyer, Michael T. van Der Veen, said during a preliminary hearing that Bam Margera is working hard on his sobriety. He said the charges should be dismissed.

“He’s taking it day by day,” van Der Veen said.

Van Der Veen said the issue involved a disagreement between brothers, not a criminal matter.

Assistant District Attorney Zachary Yurick agreed that drug and alcohol addiction is an issue with the case.

Jesse Margera testified at a hearing that Bam Margera started partying with his friends getting drunk.

“His behavior was frightening and unpredictable,” Jesse Margera testified. “He was screaming. You were not sure if he was going to tell you a funny story or stab you with a whiskey bottle.”

Jesse Margera said his brother hit him eight to 10 times, rupturing his ear.
