Former E.P. Doctor To Pay $1.2 Million Fine for Medicare, Medicaid Fraud

The US District Attorney's RI office reports Dr. Hafeez Kahn, a former local physician with practices in Smithfield and East Providence, has been fined $1.2 million, double the amount he admitted to fraudulently billing to Medicare and Medicaid. 

Kahn's restitution to the government is twice the amount of money a Settlement Agreement states he fraudulently billed, according to a joint announcement from the US Attorney’s Office, the Department of Health and Human Services, Office of Inspector General (HHS-OIG), and the Rhode Island Attorney General’s Office.

According the settlement, Kahn and two corporations he owned, U.S. Care Inc. and U.S. Care Pain Clinic LLC, overbilled the health care programs for services provided to some patients and falsely submitted claims for services never performed between August 2006 and December 2010. 

The Agreement states Kahn must make an immediate payment of $500,000 within 10 days and annual payments of $175,000 plus interest for the next five years, beginning on or before Sept. 1, 2014.

The matter, investigated by the United States Attorney’s Office, HHS-OIG, and the Rhode Island Attorney General’s Office Medicaid Fraud Control Unit, was handled by Assistant U.S. Attorney Mary Rogers and R.I. Assistant Attorney General James F. Dube.
