Department of Health Actions: Oct. 16 to Nov. 26, 2012
The following reports are based on documents released by the Rhode Island Department of Health.

The Rhode Island Department of Health has announced the following disciplinary actions. For more information, see the attached PDFs, or visit their web site.
- On Nov. 21, the department ordered 11th State Consultations, Inc., of 400 Reservoir Avenue, Providence, to close. According to the department, they collected evidence suggesting that the company made referrals for medical marijuana despite not being licensed for it. The business operators were identified as Tom Folcarelli and Maria Petrucci. The operators have the right to appeal at a hearing on Nov. 30.
- On Nov. 16, the department ordered that Bayview Pharmacy of 3045 Tower Hill Road, Saunderstown, stop compounding prescriptions. According to the department, investigators collected evidence of the compounding on Nov. 13, despite Bayview not having a license to compound. The pharmacy and department reached an agreement for extensive monitoring for the next two years in lieu of greater punishments.
- On Nov. 6, the department reached a consent agreement with Arnold Rosenbaum, 71, of 3 Wake Robin Road, Lincoln, over Rosenbaum allegedly prescribing to a family member despite being warned not to in 2009. According to the department, Rosenbaum agreed to take proper prescription classes, to serve two years of probation, and to allow an independent prescription monitoring service to look at his records for two years.
- On Oct. 26, the department reached a consent agreement with Frederick Lury, of 1090 Toll Gate Road, Warwick, for him to not practice dentistry or to write prescriptions as of Nov. 2. According to the department, an inspection of Lury’s office on Sept. 20 revealed misbranded narcotics and an expired solution. However, because Lury is in the process of retiring and selling his practice, he and the department agreed that the surrendering of his license would prevent any disciplinary action.
