Patch Morning Briefing: Trump's Appeal Response; Best U.S. Cities; DeVos Confirmation
Plus: Tainted dog food, Vizio's TV snooping, how not to lose weight, a Super Bowl wrapup and more.

Good morning, Patchers. Here's what you need to know on this Tuesday morning:
Department Of Justice Responds To Halt Of Immigration Ban
The federal government got a chance to defend President Trump's sweeping immigration ban, filing an argument in a federal appeals court on Monday night. DOJ attorneys argued that Trump has the power to restrict entry into the country, especially because the seven countries outlined in the ban have been previously identified by Congress as places that pose a terrorism risk. The attorneys are up against the states of Washington and Minnesota, a growing list of companies opposing the ban and two former top diplomats. (Patch)

Where Are The Best U.S. Cities To Live In 2017?
U.S. News & World Report is out today with its second-ever ranking of the best major cities in America to live. The publication looked at the most populous 100 cities in the country and used several objective factors, such as cost of living and crime rates, to determine their rankings. And, unlike many city rankings, this one comes from a pretty reliable source. (Patch)
Betsy DeVos Gets Her Confirmation Vote
DeVos, President Trump's controversial pick to lead the Department of Education, will go before the Senate today for her confirmation vote, which is projected to be decided by a razor-thin margin that could affect the nation's schools for years. Two Republicans have said they will vote no. If that holds, the 50-50 tie will be broken by Vice President Mike Pence, which would be the first time that's happened for a presidential cabinet confirmation. Democrats spent all Monday night on the Senate floor opposing the pick and were expected to go into Tuesday morning. (C-SPAN)
