60 Health Code Violations Reported At Fredericksburg Restaurants
The person in charge at one Fredericksburg restaurant voluntarily discarded two containers of meatballs being kept at the wrong temperature.
FREDERICKSBURG, VA — Rappahannock Area Health District inspectors reported finding a combined 60 violations at 11 of the 38 Fredericksburg food establishments they visited between March 24 and April 4.
At one restaurant, an inspector reported seeing two plastic containers overflowing with precooked meatballs being kept at 45-46 degrees inside a reach-in cooler. To prevent spoilage or the growth of harmful bacteria, these items needed to be kept at temperatures between 38-42 degrees.
The inspector shared this information with the person in charge and the two containers of meatballs were thrown out voluntarily.

- Observed the handwashing sink in the server section is at 69 degress when hot water is turned on.
- Observed ten plastic jugs of heavy cream inside the three door reach-in cooler cold holding at improper temperatures at 48-52 degrees .Through discussion with the person in charge the heavy cream has been inside the reach-in cooler sence wednesday (2 days prior to the inspection). During the inspection dairy was voluntary discarded . The three door reach-in cooler doors are not closing completely and could be the contributing to the equipment not cold holding properly. EHS will do a follow up inspection to ensure equipment is cold holding at 41 degrees or below.
- Observed the following equipment in poor repair : 1. Three door reach-in cooler at 50 degress 2.Auto Sham leaking water ( water pooling on floor under equipment ) 3. Doors do not close completely on three door reach-in cooler 4. Door handle on micowave 5. Splash guard at the handwashing sink in the server section
- Observed numerous stainless steel sheet pans encrusted on the non food contact surface .
- Observed the following non food contact surfaces in need of cleaning : 1. Exterior of cooking equipment 2. Interior of fryer cabinets
- Observed a long black hose connected to the mop sink with a spray nozzel attached and missing a dual check backflow preventer. During the inspection the person in charge turned the water off and removed the spray nozzel . EHS will do a follow up inspection to ensure a backflow prevention devise is installed.

- Person in charge could not provide the written procedures for bodily fluid cleanup. Document provided. Corrective Actions: A food establishment shall have written procedures for employees to follow when responding to vomiting or diarrheal events that involve the discharge of vomitus or fecal matter onto surfaces in the food establishment. The procedures shall address the specific actions employees must take to minimize the spread of contamination and the exposure of employees, consumers, food, and surfaces to vomitus or fecal matter.
- Observed employee drinks not covered with lids. Cups were removed. Corrective Actions: A food employee may drink from a closed beverage container if the container is handled to prevent contamination of: 1. The employee's hands; 2. The container. 3. Exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles.
- Observed both handsinks with no handwashing signage. Signs provided. Corrective Actions: A sign or poster that notifies food employees to wash their hands shall be provided at all handwashing sinks used by food employees and shall be clearly visible to food employees.
- Through discussion with the person in charge, the food thermometer is only being cleaned and sanitized once a day. Corrective Actions: Except as specified in subsection D of this section, if used with time/temperature control for safety food, equipment food-contact surfaces and utensils shall be cleaned throughout the day at least every four hours
- PIC could not provide test strips for the chemical sanitizer. Provided test strips. Corrective Actions: A test kit or other device that accurately measures the concentration in mg/L (ppm) of sanitizing solutions shall be provided and readily accessible for use.

- Corrective Actions: Equipment that is fixed because it is not easily movable shall be installed so that it is: 1. Spaced to allow access for cleaning along the sides, behind, and above the equipment. 2. Spaced from adjoining equipment, walls, and ceilings a distance of not more than 1/32 inch or 1 millimeter. 3. Sealed to adjoining equipment or walls, if the equipment is exposed to spillage or seepage.
- Observed cutting boards stained and scratched. Corrective Actions: Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that require frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material.

Through discussion with the person in charge meatballs were places in the reach-in cooler on Wednesday (two days prior to the inspection). EHS discussed with the person in charge not over filling foods above the rim line of the containers . During the inspection the person in charge voluntary discarded the foods.
- Observed a food employee preparing food while not wearing a hair restraint. During the inspection the employee put a hair restraint on.
- Observed shelving rusted by the three compartment sink and inside the two door reach-in cooler.
- Observed the following non food contact surfaces in need of cleaning: 1. Exterior and interior of all cooling equipment 2. Up splash of soda machine in the dining area 3. interior of steamers
- Observed the handwashing sink located by the three compartment sink leaking from the faucet when turned on. EHS will do a follow up inspection to ensure plumbing is in good repair .
- Through discussion with the person in charge several pieces of equipment in the facility are not working and not being used . EHS recommends the person in charge remove all unused equipment from the facility .

Corrective Actions: Except when dry cleaning methods are used as specified under 12VAC5-421-1810, surfaces of utensils and equipment contacting food that is not time/temperature control for safety food shall be cleaned: 1. At any time when contamination may have occurred.
- Observed cooked green peppers (130 degrees F) and onions (127 degrees F) in stainless steel containers held at improper temperatures on the stove. Observed the food containers double panned. Facility had three hours to use up the food. Corrective Actions: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under 12VAC5-421-850 and except as specified in subsections B and C of this section, time/temperature control for safety food shall be maintained: 1. At 135°F (57°C) or above, except that roasts cooked to a temperature and for a time specified under 12VAC5-421-700 B or reheated as specified in 12VAC5-421-760 E may be held at a temperature of 130°F (54°C) or above.
- Observed three containers of food in the walk in cooler with a date of 3/20, exeeding the 7 day mark. Foods were discarded. Corrective Actions: Except when packaging food using a reduced oxygen packaging method as specified under 12VAC5-421-870, and except as specified in subsections E and F of this section, refrigerated ready-to-eat time/temperature control for safety food prepared and held in a food establishment for more than 24 hours shall be clearly marked to indicate the date or day by which the food shall be consumed on the premises, sold, or discarded when held at a temperature of 41°F (5°C) or less for a maximum of seven days. The day of preparation shall be counted as day 1.
- Observed a chemical spray bottle next to unwrapped single use articles located on a shelve in the sandwich prep area. The bottle was re-located. Corrective Actions: Poisonous or toxic materials shall be stored so they cannot contaminate food, equipment, utensils, linens, and single-service and single-use articles by: 1. Separating the poisonous or toxic materials by spacing or partitioning. 2. Locating the poisonous or toxic materials in an area that is not above food, equipment, utensils, linens, and single-service or single-use articles. - The shelves in the dry storage are lined with cardboard. The outside of the ice machine and the back reach-in freezers still have the delivery wrapping on them. Corrective Actions: Remove the delivery wrapping from equipment so that it is easily cleanable. Use something that is not absorbent to line the shelves.
- The following non-food contact surfaces were soiled: 1) the outside of the ice machine and inside of the lid; 2) the inside bottom of the reach-in freezers; 3) the outside doors of the reach-in freezers; 4) the outside of the drink syrup lines; and 5) the racks that the syrups are on.

Except as specified in subdivision 1 d of this subsection, separating raw animal foods during storage, preparation, holding, and display from: a. Raw ready-to-eat food including other raw animal food such as fish for sushi or molluscan shellfish, or other raw ready-to-eat food such as fruits and vegetables.
- Observed stainless steel containers soiled to the sight and touch. Containers were removed for cleaning. Corrective Actions: Equipment food-contact surfaces and utensils shall be clean to sight and touch.
- Observed frozen raw chicken thawing in a container on a prep table. The chicken was re-located to the walk in cooler. Corrective Actions: Except as specified in subdivision 4 of this subsection, time/temperature control for safety food shall be thawed: 1. Under refrigeration that maintains the food temperature at 41°F (5°C) or less; 2. Completely submerged under running water: a. At a water temperature of 70°F (21°C) or below.
- Observed stainless steel containers wet while stacked in the ware wash area. Containers were removed for cleaning. Corrective Actions: After cleaning and sanitizing, equipment and utensils: 1. Shall be air dried or used after adequate draining as specified in 40 CFR 180.940 before contact with food. 2. Shall not be cloth dried except that utensils that have been air-dried may be polished with cloths that are maintained clean and dry.
- Observed the following in need of cleaning: 1) interior/gaskets of reach in coolers. 2) shelving throughout. Corrective Actions: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.
- Observed the top interior of the grease receptacle in need of cleaning. Corrective Actions: Soiled receptacles and waste handling units for refuse, recyclables, and returnables shall be cleaned at a frequency necessary to prevent them from developing a buildup of soil or becoming attractants for insects and rodents.
- Observed the following in need of cleaning throughout the kitcken: 1) floor drains. 2) floors underneath the equipment. 3) walls. 4) ceiling vents/tiles. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.

- Observed inconsistent datemarking on TCS/RTE foods in the reach in coolers on the line. Corrective Actions: A food specified under 12VAC5-421-830 A or B shall be discarded if it: 1. Exceeds either of the temperature and time combination specified in 12VAC5-421-830 A, except time that the product is frozen. 2. Is in a container or package that does not bear a date or day. 3. What Violations Do VDH Inspectors Report?
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.
Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
