Fredericksburg Restaurant Stored Eggs And Raw Chicken Incorrectly, Inspectors Say
Rappahannock Area Health District inspectors visited 42 food establishments in Fredericksburg, finding violations at 21 of them.
FREDERICKSBURG, VA — Rappahannock Area Health District inspectors reported finding a combined 73 violations at 21 of the 42 Fredericksburg food establishments they visited April 7-26.
At one food establishment, an inspector reported finding raw chicken and hardshell eggs stored above ready to eat foods in the walk-in cooler. The items were rearranged to protect food from cross contamination.
"A food employee handled soiled dishes then handled clean dishes without first washing their hands," an inspector wrote in their report about another restaurant. "Dishes were re-located to be cleaned and sanitized. Employee was instructed to wash their hands."

- A food employee handled soiled dishes then handled clean dishes without first washing their hands. Dishes were re-located to be cleaned and sanitized. Employee was instructed to wash their hands. Corrective Actions: Instruct food employees to clean their hands and exposed portions of their arms immediately before engaging in food preparation including working with exposed food, clean equipment and utensils, and unwrapped single-service and single-use articles and during food preparation, as often as necessary to remove soil and contamination and to prevent cross contamination when changing task.
- Observed several stainless steel containers stored on the shelving unit used for clean dishes to be soiled to the touch and sight. Person in charge relocated the items to the warewashing area to be cleaned and sanitized. Corrective Actions: Equipment food-contact surfaces and utensils shall be clean to sight and touch.
- Observed a hose attached to a Y connector without an air gap. The hose did not have a sprayer, therefore it was not under continuous pressure. EHS instructed the PIC to created the required air gap of a one inch between the hose and flood level rim or install a hose bib. Corrective Actions: A plumbing system shall be installed to preclude backflow of a solid, liquid, or gas contaminant into the water supply system at each point of use at the food establishment, including on a hose bibb (threaded faucet) if a hose is attached or on a hose bibb if a hose is not attached and backflow prevention is required by law by: 1. Providing an air gap as specified under 12VAC5-421-2200;P or 2. Installing an approved backflow prevention device as specified under 12VAC5-421-2210.
- Observed the ceiling tiles throughout the kitchen in need of cleaning. Corrective Actions: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food.

Corrective Actions: Food employees and conditional employees are informed in a verifiable manner of their responsibility to report in accordance with law, to the person in charge, information about their health and activities as they relate to diseases that are transmissible through food, as specified under 12VAC5-421-80.
- PIC could not provide the written bodily fluid clean up procedures. Document provided. Corrective Actions: A food establishment shall have written procedures for employees to follow when responding to vomiting or diarrheal events that involve the discharge of vomitus or fecal matter onto surfaces in the food establishment. The procedures shall address the specific actions employees must take to minimize the spread of contamination and the exposure of employees, consumers, food, and surfaces to vomitus or fecal matter.
- Observed no paper towels at the ware wash handsink. Paper towels were placed at the handsink. Corrective Actions: Each handwashing sink or group of adjacent handwashing sinks shall be provided with: 1. Individual, disposable towels. 2. A continuous towel system that supplies the user with a clean towel. 3. A heated-air hand drying device. 4. A hand drying device that employs an air-knife system that delivers high-velocity, pressurized air at ambient temperatures.
- Observed raw chicken and hardshell eggs over RTE foods in the walk in cooler. Items were re-arranged. Corrective Actions: Food shall be protected from cross contamination by: 1. Except as specified in subdivision 1 d of this subsection, separating raw animal foods during storage, preparation, holding, and display from: a. Raw ready-to-eat food including other raw animal food such as fish for sushi or molluscan shellfish, or other raw ready-to-eat food such as fruits and vegetables. b. Cooked ready-to-eat food. c. Fruits and vegetables before they are washed. d. Frozen, commercially processed, and packaged raw animal food may be stored or displayed with or above frozen, commercially processed and packaged, ready-to-eat food;
- Per discussion with the person in charge, the dishes and the bread dough roller machine are only being washed and rinsed without a sanitizing step. Corrective Actions: Equipment food-contact surfaces and utensils shall be cleaned: 1. Except as specified in subsection B of this section, before each use with a different type of raw animal food such as beef, fish, lamb, pork, or poultry. 2. Each time there is a change from working with raw foods to working with ready-to-eat foods. 3. Between uses with raw fruits and vegetables and with time/temperature control for safety food. 4. Before using or storing a food temperature measuring device. 5. At any time during the operation when contamination may have occurred.
- Observed the can opener in need of cleaning. Can opener was removed for cleaning. - Observed the pizza cutting board stained and scratched. Corrective Actions: Equipment food-contact surfaces and utensils shall be clean to sight and touch.
- Upon arrival of the inspection, PIC could not provide sanitizer for the cleaning of dishes. Facility ended up having chlorine bleach for food contact surfaces. Sanitizer was made from the bleach. Corrective Actions: Utensils and food-contact surfaces of equipment shall be sanitized before use after cleaning.
- Observed no datemarking system of TCS/RTE foods. Corrective Actions: A food specified under 12VAC5-421-830 A or B shall be discarded if it: 1. Exceeds either of the temperature and time combination specified in 12VAC5-421-830 A, except time that the product is frozen. 2. Is in a container or package that does not bear a date or day. 3. Is inappropriately marked with a date or day that exceeds a temperature and time combination as specified in 12VAC5-421-830 A.
- Observed the only food employee not wearing a hair restraint. Corrective Actions: . Except as provided under subsection B of this section, food employees shall wear hair restraints, such as hats, hair coverings or nets, beard restraints, and clothing that covers body hair, that are designed and worn to effectively keep their hair from contacting exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles.
- Observed knive blades chipped. Corrective Actions: Multiuse food-contact surfaces shall be: 1. Smooth. 2. Free of breaks, open seams, cracks, chips, inclusions, pits, and similar imperfections. 3. - Observed the 3comp sink and handsinks in need of re-caulking. Corrective Actions: Equipment that is fixed because it is not easily movable shall be installed so that it is: 1. Spaced to allow access for cleaning along the sides, behind, and above the equipment. 2. - Observed the following non food contact surfaces in need of cleanning: 1) interior of cooling equipments. 2) shelving. Corrective Actions: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.

- Observed a food employee handle personal belongings then started preparing a drink without washing their hands. Observation was discussed with the person in charge (PIC). PIC instructed employees to properly wash their hands. (corrected) Corrective Actions: Instruct food employees to clean their hands and exposed portions of their arms immediately before engaging in food preparation including working with exposed food, clean equipment and utensils, and unwrapped single-service and single-use articles and during food preparation, as often as necessary to remove soil and contamination and to prevent cross contamination when changing task.
- Through discussion with the food employee the espresso steam wand which comes in contact with dairy is not sanitized every 4 hours. Wash, rinse and sanitize step is conducted once a day. Instructed the person in charge to wash and sanitize the spindle at least once every 4 hours. Person in charge instructed employees to clean and sanitize the item. (corrected) Corrective Actions: Food contact surfaces of equipment and utensils must be cleaned and sanitized at least every 4 hours to prevent contamination by bacterial growth.
- Observed breakfast sandwiches stored in the grab and go refrigerator located in the lobby without any labels. Sandwiches were relocated to the back of the house. (corrected) Corrective Actions: Food packaged in a food establishment, shall be labeled as specified in accordance with all applicable laws and regulations. Label information shall include: 1. The common name of the food, or absent a common name, an adequately descriptive identity statement; 2. If made from two or more ingredients, a list of ingredients and sub-ingredients in descending order of predominance by weight, including a declaration of artificial colors, artificial flavors, and chemical preservatives, if contained in the food; 3. - Absence of handwashing signage at the front handwashing sink. Sample signage provided to the owner. Corrective Actions: A sign or poster that notifies food employees to wash their hands shall be provided at all handwashing sinks used by food employees and shall be clearly visible to food employees.
- Absence of date marking system in the food establishment. Observed various ready-to-eat TCS foods prepared more than 24 hours in advance which were not dated. Implement a date marking system in the food establishment. Provided date marking handout to the operator. Corrective Actions: A food specified under 12VAC5-421-830 A or B shall be discarded if it Is in a container or package that does not bear a date or day.
- Food establishment uses time as a public health control, in lieu of temperature control, for prepared pizza. The operator could not provide documentation or procedures. A signed time as a public health control documentation was provided and signed on 7/20/2023. Provided a copy to the owner. Corrective Actions: if time without temperature control is used as the public health control for a working supply of time/temperature control for safety food before cooking or for ready-to-eat time/temperature control for safety food that is displayed or held for sale or service, written procedures shall be prepared in advance, maintained in the food establishment.
- Observed accumulation of debris on the following nonfood contact surfaces: 1. Interior and gaskets of reach in refrigeration, 2. Shielded light covers under the hood. 3. pizza oven 4. Dust accumulation on the hood equipment Corrective Actions: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.
- Observed the following areas in need of cleaning: 1. Caulk at and faucet handles of the kitchen handwashing sink. 2. Flooring under equipment and 3 vat sink. 3. Caulking at 3 compartment sink. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.

- The utensil surface temperature only reached 153.8°F as measured by an irreversible registering temperature indicator. The irreversible registering temperature indicator was run through the dish machine five times. Corrective Actions: The person in charge will have employees sanitize the dishes in the three-compartment sink until the dish machine is fixed. Repair person will be called to service the machine.
- The door of the walk-in freezer doesn't close completely, and this has caused some icing in the back of the walk-in freezer.

What Violations Do VDH Inspectors Report?
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.
Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
