Shoreline Council Votes to Offer O'Neills $100,000 Plus Attorney's Fees

Council hopes to settle O'Neill vs. Shoreline suit which was originally filed in 2006

The Shoreline City Council voted to make anΒ offer of Judgment to Doug and Beth O'Neill of Shoreline to settle their lawsuit against the city that was orginally filed in 2006.

The suit concerns the city's failure to provide a public record of metadata from an e-mail sent and forwarded several times to then Deputy Mayor Maggie Fimia. The case was one of first impression in the United States, meaning it had never been considered by the courts before.Β 

The Council met in executive session for about 20 minutes after hearing a staff report from assistant city attorney Flannery Collins and Fimia's attorney, before voting.

The Council approved an offer to pay $100,000 in penalties to the O'Neills as well as court decided attorney's fees.

The Council voted 6-0 to approve the offer; Councilmember Jesse Salomon was not present.Β

The O'Neills have 10 days to respond by Sept. 27 to the offer. They have not responded to previous offers to settle.Β
