Man Accused In Waukesha Parade Attack Seeks Dismissal Of Case: Reports
Attorneys for the man accused of driving through the 2021 Waukesha Christmas Parade recently filed for the case's dismissal, reports said.

WAUKESHA, WI — The man accused of driving through the 2021 Waukesha Christmas Parade recently had a motion filed by his lawyers seeking to dismiss the case, according to reports.
At the center of one motion, Darrell Brooks Jr.'s lawyers argued a recent search of his jail cell violated his rights, The Waukesha Freeman first reported. Brooks' defense argued the July 1 search infringed on attorney-client privilege, the Freeman report said.
The jail cell search came when investigators were looking for information about Brooks changing his plea to not guilty by reason of mental disease, according to the Freeman.

Brooks is facing 83 charges in Waukesha County, among them six first-degree intentional homicide charges and 60 charges of first-degree recklessly endangering safety, online court records showed.
Two hearings are scheduled in August for Brooks, including one where discussion is expected on the recent motions. Afterward, a jury trial of Brooks is slated to begin in October.

With the motion, Brooks' public defenders asked for the case to be dismissed, or for those on the prosecution team who viewed possibly privileged material after the search in July to be removed, according to a report by The Milwaukee Journal Sentinel.
Waukesha County District Attorney Susan Opper responded in part to the motions by saying Brooks did not establish which document may have been privileged or which document would have impacted his defense, the Journal Sentinel report said.
