New Charges For Waukesha Teen Accused Of Bringing Guns To School

WAUKESHA, WI— The 18-year-old Waukesha South student accused of bringing two pellet guns to Waukesha South High School, in an incident where he was later shot and injured during a confrontation with police in December is facing new charges, according to a criminal complaint.

Tyrone Smith was charged with three new counts of felony bail jumping on Aug. 21. He was also charged the same day with battery, disorderly conduct, and obstructing an officer, all misdemeanor charges.

Smith has twice been charged with felony bail jumping for violating terms of his house arrest release.

During an Aug. 26 court hearing, Smith's attorney asked the judge in the case to order a competency exam. Smith's next hearing is scheduled for Sept. 17.

Latest incident

The criminal complaint explains two incidents. On Aug. 16, a Waukesha Police officer was flagged down by a 17-year-old who reported he was "jumped" behind Marko's Pizza near East Broadway, according to the criminal complaint. He told police two males ran from a house nearby and repeatedly struck him in the face. The complaint said the 17-year-old identified one of the males as Smith. Smith lives on Barney Street, and has been under house arrest with a GPS monitor, according to online court reports.

Smith and the other male said they didn't see any physical altercation, the complaint says. The GPS tracker placed Smith at a residence at McCall Street and police learned Smith was associated with a 13-year-old female who lived there, the complaint said.

The teen said she was friends with Smith and told him about her "on and off" relationship with the 17-year-old who was hit in the face, according to the complaint. She told police the 17-year-old showed up on Aug. 16 and both males got into a fight, the complaint said.

In the second incident, a detective arrived at the house on McCall Street on Aug. 19. The detective spotted Smith and another male in a car in the driveway, according to the complaint. The complaint said Smith only gave "T.Y." as his name before revealing who he really was. Smith, who has a revoked license, was seen driving there by witnesses, the complaint says.

The complaint also said Smith lied about having permission to leave his home.

Shooting in December

Smith was charged in December with second-degree recklessly endangering safety with a dangerous weapon; resisting an officer; disorderly conduct with a dangerous weapon and possessing a dangerous weapon at school.

Police previously stated Smith had become angry at a fellow student, and brought two guns to school — both pellet guns. Police said the Waukesha South High School student approached a School Resource Officer, saying that Smith brought a gun to school and pointed it at another student's head.

At the time, the School Resource Officer and a Police detective were in the school office. They ran to the classroom where Smith was located. The classroom was quickly evacuated as the School Resource Officer and Detective began to negotiate with him.

Smith removed a gun from his waistband and pointed it at officers. A Waukesha Police officer shot Smith a total of three times: once in the upper right thigh and in the arm twice, police said.
