West Allis Man Charged In U.S Capitol Riot

MILWAUKEE COUNTY, WI—A West Allis man was charged in connection with the breach of the U.S. Capitol on Jan. 6. David Mish Jr., 42, faces charges of unlawful entry on restricted grounds and violent entry and disorderly conduct on Capitol grounds.

Mish on Jan. 7 contacted the Metropolitan Police Department in Washington saying that he had information to provide about the fatal shooting of Ashli Babbitt, according to the criminal complaint. Babbitt was shot inside the U.S. Capitol during the violent insurrection.

Mish admitted that he and several others entered the Capitol, the complaint said. He asked during the phone interview, “Because I entered the Capitol building, are you guys gonna take me to jail? I didn’t break anything. ... I went in, yes," according to the criminal complaint.

Mish subsequently said, “I came up the stairs where the scaffolding was. Um, I was with a group of guys. ... Everybody was yelling, ‘Breach the building," the complaint said.

A review of video footage of the riot and investigation led authorities to believe Mish was by the Speaker's Lobby inside the Capitol.

In his interview with a detective, Mish said a group of people went into the bathroom adjacent to the speaker's lobby, the complaint said.

Mish quoted Babbitt telling an officer at the doorway, “Just open the door. They’re not gonna stop," referring to the crowd, the complaint said.

“From my video, you can tell that I was one of the, I was the first group of people to hit that doorway,” Mish said, according to the complaint. Mish said he would provide the video footage and emailed a link to a Google Drive folder, the complaint said. To date, neither the police department nor the FBI have been able to access the content of the link.

Mish described his clothing as a “black sweater, ... blue jeans, ... blue lives matter with a ... United States flag on the hat, and the hat is blue.” Mish's clothing and face were identifiable on video footage, the complaint said.
