UPDATE: Police Say Man Accused of Rape, Sodomy Had Prior Assault of Same Victim

Hemet police investigated an alleged sexual assault of a female resident Tuesday and a man on probation was arrested on suspicion of rape, sodomy, assault and other charges, a police lieutenant said Wednesday.

The arrested man, identified as Sheldon Ray Johnson, 24, of Moreno Valley, had a prior conviction of assaulting the same woman, Hemet PD Lt. Duane Wisehart said. Johnson was held without bail Wednesday afternoon at Smith Correctional in Banning on suspicion of six felonies, according to inmate records.


About 2:40 p.m. Aug. 27 officers responded to the 3100 block of Warley Road for a report of a possible residential burglary in progress, Wisehart said.

When police arrived they became involved in a physical struggle with two adult males suspects and were able to detain them, Wisehart said.

"Officers then contacted the female resident of the home, who was found to be seriously injured," Wisehart said. "The victim was soon after transported to a local hospital for medical attention."

Johnson was arrested and the other detained man was released after police determined he was not involved with the incident, Wisehart said.

Police said Johnson faces charges including rape by force/fear, sodomy, sexual penetration, domestic violence with prior, false imprisonment, burglary, and assault with intent to commit rape.

"Johnson is on A5109 probation, had a prior dating relationship with the victim, and had previously served time in state prison for assaulting the victim," Wisehart said. "The victim  did have an active domestic violence restraining order against the suspect."

Hemet police Capt. Rob Webb said Johnson does not seem to fit the criteria of a non-violent offender under A5109.

"Police are researching the circumstances under which Johnson was released from his most recent prison term as well as the severity of the charges he was convicted of and incarcerated for in that case," Wisehart said.

Johnson has a court date Thursday Aug. 29 at Southwest Justice Center in Murrieta, according to inmate records.
