Minor Allegedly Served Alcohol During Benicia PD Sting

A 17-year-old was served alcohol at Benicia sports bar Bottom of the Fifth during a sting Wednesday, police say.

The police operation involved tests at 15 businesses and bars that sell and serve alcohol, and all but one passed by not selling to the underage teen, according to a Benicia Police Department press release.

At Bottom of the Fifth, police say an employee checked the decoy's ID–which showed him as being 17 years old–but served him alcohol anyway.

Rachelle McCarty, a 40-year-old Bottom of the Fifth employee who lives in El Sobrante, was issued a misdemeanor citation on charges of selling alcohol to someone younger than 21 years old.

The businesses that passed the compliance check were:

8. Rite Aide, 60 Solano Sq
9. Valero Gas, 1925 East 2nd St
10. Texaco Gas, 6001 Goodyear Rd
11. Fast & Easy, 1500 East 5th St
12. Liquor Warehouse, 457 Military East
13. 7 Eleven, 500 Military East
14. 76 Gas, 505 Military East

“We are extremely pleased with the businesses that followed the law and asked for identification and did not sell to the minor decoy,” the press release quoted Benicia Police Lt. Frank Hartig as saying. “The goal of the program is zero sales, zero citations, and alcohol free and healthier youth. Total compliance with alcohol and tobacco sales laws is the department's mission."
