Danville Town Council To Review Revised Inclusive Housing Ordinance

DANVILLE, CA — The Danville Town Council will consider an ordinance to update the town's Inclusionary Housing Ordinance.

The original ordinance was adopted in 1994 and last updated in 2014, according to a town staff report. In accordance with Danville's 2023-2031 Housing Element, the revised ordinance introduces tiered affordability requirements based on project size and density. For low-density developments, 5% of units must be designated for low-income households, and 5% of units must be designated for moderate-income households. For developments with 21 or more units, 5% must be designated for very low-income households, 5% for low-income households, and 5% for moderate income households.

Additional changes include reducing the minimum size for accessory dwelling units from 500 to 400 square feet, and allowing ADUs to be used or up to 25% of a project's Below Market Rate obligation if approved by the town.

Developers may also request waivers or modifications to development standards to offset the BMR units. BMR units must remain affordable for at least 20 years, with preference given to Danville residents and workers.

The ordinance is scheduled for a first reading on Tuesday, and a second reading on Aug. 12. If approved at both meetings, it will take effect 30 days later on Sept. 11.
