Hermosa Beach Woman Sues Debt Collector For Abusive Collection Tactics

The woman alleges the company violated the Telephone Consumer Protection Act and Fair Debt Collection Practices Act.

HERMOSA BEACH, CA — A Hermosa Beach woman is suing a debt collection firm alleging it violated the Telephone Consumer Protection Act, the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

In her complaint, Allison Brown alleges the collection firm Simon's Agency Inc. kept calling her to collect on a debt even after she told the company to stop calling her. Brown claims the company refused to stop calling her and used a robo-dialer to call her in violation of federal laws.

She is asking for statutory damages, punitive damages, actual damages and legal fees. Telephone Consumer Protection Act forbids the use of automatic telephone dialing systems and artificial or prerecorded voice messages and the Fair Debt Collection Practices Act prohibits debt collectors from using abusive, unfair, or deceptive practices to collect on debts.
