Mixt Greens received a conditional use permit from the Planning Commission on May 18, 2010, which allowed the restaurant to serve beer and wine, the report states. That permit will remain active with the transfer of the space.
The proposed project includes the construction of an outdoor patio, where alcohol will be prohibited. The change of the outdoor patio will require the widening of the sidewalk, according to Fernandez.
Chipotle is seeking to change the hours of operation from 10:30 a.m. - 9 p.m. to 11 a.m. - 10 p.m., which is similar to the hours of operation of nearby businesses, according to the report.
The report also found that the restaurant is "consistent with existing surrounding land use."
The hearing comes as city staff is examining, among other things, what percentage of retail outlets can be chain stores, as well as the areas of the city where the ordinance should be applied. ()
