2 San Leandro Councilmembers Subject To Censure Hearing

An independent investigation found the pair "interfered with the administrative responsibilities of former City Manager Fran Robustelli."

SAN LEANDRO, CA — The San Leandro City Council will hold a hearing later this month to decide whether to censure two of its members over allegations they interfered with the work of the city manager.

A complaint was filed in May by former City Manager Fran Robustelli, who alleged Vice Mayor Fred Simon made threats about her job and performance evaluation. During the course of an investigation by an independent law firm, the probe expanded to include Councilmember Victor Aguilar, Jr.

After Robustelli filed a complaint in May, the San Leandro City Attorney hired Botterud Law Workplace Investigations of Pasadena to investigate.

The firm's report substantiated most of Robustelli's allegations, which centered around threats to her employment and performance evaluation. The report, submitted on Oct. 30, found that the two councilmembers interfered with the work of Robustelli in violation of the City Charter.

Robustelli left the city in July and is now city manager for St. Pete Beach, Florida. She maintained that she was subjected to discrimination, retaliation and harassment during her three years as San Leandro's city manager.

On Monday, the City Council voted 4-1 to hold a censure hearing against Simon and Aguilar on Nov. 18 to determine if any discipline is warranted.
