Man Arrested in Saratoga For 4th DUI
Punishment for felony drunken driving, with three prior similar offenses in less than 10 years, is 180 days, or six months in jail.

A Modesto man was arrested in Saratoga for his fourth DUI in less than 10 years the evening of July 6 by Santa Clara County sheriff's deputies.
Alexander Smith, 27, was taken into custody at 11:55 p.m. at Saratoga Avenue and Highway 9, according to a sheriff's report.
He was charged with felony DUI within 10 years of three other drunken-driving arrests.

If convicted, Smith will automatically be imprisoned in Santa Clara County Jail for a minimum of 180 days, or six months.
His bail amount was set at $100,000, according to the report.

It's not known at this time whether he posted bail or remains in custody.
His privilege to operate a motor vehicle could also be revoked by the Department of Motor Vehicles and he could be asked to surrender his driver's license to the court.
Also, if found guilty, Smith will be designated as a habitual traffic offender for a period of three years, according to the law.
According to criminal defense attorney and legal analyst Steven Clark, four DUIs within 10 years is a felony with a maximum penalty of three years in jail.
