Judge Grants Temporary Restraining Order Against Superior For Assault Weapon Ban
The temporary restraining order was granted after the Rocky Mountain Gun Owners, a far-right gun rights group, sued the town.

A federal judge granted a temporary restraining order Friday against Superior for its assault weapon ban after the Rocky Mountain Gun Owners, a far-right gun rights group, sued the town. The order will remain in effect for 14 days.

The temporary order bars the town from enforcing its prohibition of the possession, sale or other transferring of assault weapons, large-capacity magazines, rapid-fire trigger activators and certain other weapons. The order also halts a certificate and background check requirement for owners who possessed these weapons before July 1.
The order does not address a portion of the town’s ban that says gun owners cannot openly carry firearms in a public place.

“We believe this spells the end of the Colorado mag ban. And to Colorado cities with similar ordinances — you’re next,” Dudley Brown, president of the RMGO, said in a statement.
The Boulder, Lafayette and Louisville governments have all recently approved gun violence prevention ordinances.
Superior’s assault weapon ban passed with a unanimous vote from the town board in June to update regulations. The lawsuit, filed July 7 in U.S. district court in Denver, lists the town of Superior and Boulder County Sheriff Joe Pelle as plaintiffs. The National Association for Gun Rights and Superior resident Charles Bradley Walker accompany RMGO as plaintiffs in the suit.
The town of Superior declined to comment regarding the temporary restraining order.
A status conference will be held among the parties July 29 to discuss the temporary order and the ruling of a deferred preliminary injunction.
