Haddam Resident Charged with DUI, Resisting Arrest

43-year-old Timothy Scott of Haddam was charged June 26 with a DUI. Scott was allegedly driving his scooter on Saybrook Road under the influence. Police say is BAC was .2230.

The following information was provided by court documents at Middletown Superior Court. An arrest does not constitute a conviction and all defendants are innocent until proven guilty in a court of law:

According to court documents at Middletown Superior Court, Haddam resident Timothy Scott, 43, of 15 Highmeadow Place Apt. #D, is facing charges of a illegal operation of a motor vehicle under the influence of alcohol/drugs, driving with a suspended license, and interfering with an officer/resisting arrest, stemming from a June 25 arrest.

The arraignment/probable cause affidavit paperwork states that around 6 PM on June 25, Trooper April Pawlow was dispatched to Saybrook Road in Haddam "on a report of a disturbance between a male and a female."

Upon arriving at the scene, Pawlaw observed two other officers there with a "shirtless white male standing next to a red scooter in the shoulder of Rt. 154." The Trooper also saw a female sitting on the side of the road, according to the affidavit.

The male was then identified as Timothy Scott and the female as his girlfriend. One of the officers reported that "upon speaking with Scott he observed an odor of an alcoholic beverage."

Police say Scott admitted to having "a few drinks earlier in the day" and also stated his last drink was "about an hour ago." Pawlaw stated in the affidavit that Scott's eyes were blood shot, his mouth was dry, his speech was slurred and he was swaying. 

The Trooper then administered three sobriety tests, including a horizontal gaze nystagamus, walk and turn and a one leg stand, police stated in the affidavit. Police say he failed all three, and was subsequently charged with a DUI and driving with a suspended license. 

According to the affidavit, Scott's BAC was at .2230 about 45 minutes after his arrest, and .1879 about an hour after the arrest. According to the DMV, you are legally intoxicated if your BAC is .08 or above.

When Pawler and another Trooper were escorting Scott to the police car, police say he was "actively resisting" and became "hostile" with the Trooper. Police say Scott was calling him names and trying to entice him into a fight, according to the affidavit. Police say they attempted to get Scott into the passenger's seat of cruiser, but he "stiffened right up" and refused to get in. Scott was then subsequently charged with interfering with an officer/resisting arrest. 

The affidavit stated Scott sustained a "laceration to the left side of his head above his eye" during the struggle, but refused medical attention.

Scott was given a bond amount of $2,500 cash or surety, according to the affidavit, but was unable to make it. At close to 11 PM, he was transfered to Hartford Correctional Facility and set to appear in court June 26. He appeared in court on June 26, and the case was continued. He is next set to appear in court July 30.

According to The Middletown Press, Scott was also arrested earlier this year, on May 26 and charged with a DUI. They report Scott:

"...Was arrested May 26 and charged with driving under the influence after an incident at CVS on Main Street Extension... Scott allegedly left the scene on a scooter, and when police stopped him, he started to cry, police said. His blood alcohol level tested at .2488 and .2528, according to police. He was released on a $500 non-surety bond and was scheduled to appear in court June 6."

According to Public Records, Scott was charged in February of this year with Breach of Peace in the 2nd degree and assault in the 3rd degree.
