'Spice' Ban on Hold in Gulfport

Gulfport City leaders unanimously voted to table the proposed "spice" ban.

Although councilors unanimously voted to pass the proposed "spice ban" during first reading, much debate about the laws language and purpose was brought up during the June 18 meeting.

The proposed ban only applies to the sale and distribution of illicit synthetic drugs and bath salts. It does not address the use or possession of the substances commonly referred to as "spice" and "k2."

As explained during first reading, the ordinance is aimed at stopping the sale and distribution of these substances. Gulfport Police Chief Robert Vincent explained that the wording would allow officers to immediately seize substances and enforce the ban at point of sale. Basically the ban would focus on how it's packaged and how it's sold. The reason for this is that once state and local lawmakers pass a ban on a substance based on chemical mixture, those making the synthetic drugs change the mixtures again to make them legal.

During second reading, residents and councilors brought up concerns about definitions and possibly strengthening or at least clarifying the law.

Gulfport resident Lee Stepella suggested expanding the definition of "seller" to include shop owners, managers, and businesses themselves. This would hold more people responsible.

Stepella also brought up concerns about the fine amount. She stated that surrounding cities such as Pinellas Park have a $500 fine, while the one proposed here is just over $200.

Resident Tim Spencer spoke up and asked if the ordinance would apply to individuals selling "spice" "k2" or other illicit synthetic drugs and bath salts.

As a result of the discussion, council voted 5-0 to table the ordinance and bring it forward for further discussion at a workshop. The next available workshop will be held on August 8 at 4 p.m. at Gulfport City Hall.
