Alleged Driver in Fatal Kennesaw Collision Charged

Brian Marcus was behind the wheel of a Chevrolet Avalance when he allegedly hit an 83-year-old woman as she crossed Busbee Parkway.

A Woodstock man turned himself in this week on charges related to a crash that killed an elderly woman last month as she crossed the street.

Brian Marcus, 52, is charged with one count each of second degree vehicular homicide and hitting a pedestrian, both of which are misdemeanors.

Marcus turned himself into Cobb County police on Monday, Oct. 5 and was released on a $25,000 bond overnight Tuesday, booking records show.

83-year-old Katie Swinehamer was heading north across George Busbee Parkway at Frey Road when a 2012 Chevrolet Avalanche turned left from soutbound Frey Road onto eastbound George Busbee Parkway at 7:53 a.m. on Sept. 9. The Avalanche hit Swinehamer when she was in the left lane, police said.

Swinehamer was rushed to WellStar Kennestone Hospital for treatment but died from her injuries that afternoon, police said.

Marcus was not injured in the collision, police said.
