
A Kennesaw man is accused of driving under the influence with a 7-year-old girl inside his car, then shoving the officer who tried to arrest him.
Just after 11 p.m. March 16, police noticed a white 2003 Toyota Corolla going from lane to lane along Shiloh Road and Royal Drive, according to a Cobb County criminal warrant.
When authorities pulled the car over, they found a 7-year-old child sleeping "length-wise" in the back seat and Robert Shamon Paynes behind the wheel.

"Accused had an odor of an alcoholic beverage coming from his breath and admitted to drinking," the officer wrote in the warrant. "Accused had glassy and bloodshot eyes. Accused submitted to voluntary field sobriety evaluations."
Police tried to place Paynes under arrest, but he allegedly fought with, then pushed the officer, who "fell to the ground on the roadway near the backside of the patrol car during the struggle."

Disobeying commands to stop, Paynes took off into a wooded area before police used a Taser to stop him.
Paynes was arrested and charged with willful obstruction of a law enforcement officer, driving under the influence of alcohol, endangering a child by driving under the influence of alcohol, failure to maintain lane, child safety restraints violation and willful obstruction of a law enforcement officer.
He was released March 17 on a $5,000 bond.
