Loganville Package Store License Process Faces Three Appeals
Loganville awarded two package store licenses in April, one in Gwinnett and one in Walton County. Three of the unsuccessful applications, however, have been appealed to Superior Court.
If you were excited about the possibility of two package stores soon coming to the City of Loganville, don't hold your breath. By Monday, three of the unsuccessful applications had filed appeals with the Superior Court.
After denying all but one application initially, the city reversed its denial of one of the applications at a hearing last month. With only two successful applications, the city decided a lottery would not be necessary and proceeded to award the two successful applications - one in Walton County and one in Gwinnett County. It did note, however, that the process allowed 30 days for those applications that were not successful to appeal the denials to the superior court of either Walton or Gwinnett County.
Those appeals have now been filed.

In Gwinnett County
Highway 78 Real Estate LLC on Property at 330 Athens Highway, Loganville
Initially the application from Highway 78 Real Estate LLC was denied. It was, however, the only one that was overturned on appeal. The application was submitted by Douglas ford and his father, Richard Ford.
The Fords originally started the process last year with a petition to get the issue on the ballot. they had to go through the process of getting the application in and approved. The initial application was denied based on the number of parking spaces - it came up six short. The denial, however, was overturned based on the fact that there appeared to be a misinterpretation on what qualified as retail sales space and what qualified as warehouse space.
There was one other application in Gwinnett County - one by Ronald D. Harrison, Sr./DHVW, LLC. It was denied initially and the denial upheld on appeal. That has now been appealed to the Gwinnett County Superior Court.
The successful application in Walton County was by Ronald R Camp is for property adjacent to the Loganville American Legion on Highway 78. However, a second application by the Camp Family Partnership also has been appealed, in this case to the Walton County Superior Court. A second appeal to Walton County has been filed by Buddy Balance for property on Highway 78 close to Kroger. The initial denials of both those applications were upheld on appeal.
City Manager Bill Jones said he does not know how long the appeal process will hold up the two successful applicants being able to proceed with construction of the package stores.
