Austell Man Arrested in Powder Springs Custody Dispute

Cobb authorities arrested David Horace Garmon Saturday at his home.

As a 10-year-old girl listened to the back-and-forth between her soon-to-be divorced parents, her father allegedly uttered these words to the girl's mother through a telephone: "I'll bury you six feet under the ground if you don't let our daughter spend the night with me this weekend."

And that, Cobb authorities say, is why they arrested David Horace Garmon Saturday at his Austell home on charges that include terroristic threats and harassing phone calls.

The girl, her mother and two other juveniles were in a Powder Springs parking lot in the 1000 block of Richard D. Sailors Parkway about 4 p.m. Friday when Garmon allegedly made the threat.

According to the court custody papers, Garmon can see his daughter every other Sunday. But on Friday, Garmon wanted the girl from Saturday to Sunday, according to a Cobb County arrest warrant. When his estranged wife said no, Garmon allegedly became irate. He was on speakerphone at the time, and his wife told him that children as young as 7 years old were in the car.

The foul language continued, according to the warrant.

While allegedly calling his wife "money hungry" and other derogatory names in a subsequent phone conversation with law enforcement, Garmon "insisted that he was not serious," according to the warrant. "He only said it because he was angry."

Garmon was released Saturday night from the Cobb County Adult Detention Center on a $5,000 bond.
