UPDATE: Silver Comet ATV Rider Charged with Involuntary Manslaughter

An Austell man is being charged with involuntary manslaughter after he and his friend collided with a pole on the Silver Comet Trail while riding in an ATV and she died.

UPDATE July 14 at 8 a.m.

Gianisiracusa turned himself into police on Thursday morning and was released by 3:45 p.m. the same day after posting a $20,000 bond, according to a report from the Atlanta Journal-Constitution.

Witnesses reported seeing both Gianisiracusa and Neesley driving the ATV, owned by Giansiracusa, that night, the report states.

Police have stated that alcohol was likely a factor in the crash, and Giansiracusa could face other charges once the toxicology results are returned.

An arrest warrant has been issued for the man who was riding in an ATV on the Silver Comet Trail with when the vehicle collided with a pole and burned on June 30. Neesley, who lived in Austell, was ejected from the vehicle and died as a result.

Randall P. Gianisiracusa, 52 of Austell, was the other occupant of the ATV. He sustained minor injuries as a result of the crash, which occurred east of Floyd Road.

He was treated at the scene and then released.

Now, Cobb police have charged Gianisiracusa with involuntary manslaughter, reckless conduct and criminal trespass.

According to police, Gianisiracusa's attorney has been notified of his arrest warrant and he is expected to turn himself into authorities at the Cobb County jail.
