Trial of Alleged Penske Shooter to Begin in May

Despite pleas from his lawyers to stop his death penalty case, the man accused of shooting five people at the Hertz Penske Truck Rental facility in Kennesaw more than three years ago will go to trial in May.

Lawyers for Jesse James Warren filed motions Monday in which they argued that their client was insane at the time of the shootings and is mentally incompetent to stand trial now, according to WSB-TV.

However, Cobb County Judge Mary Staley set a May 28 trial date, the Atlanta Journal-Constitution reported.

Warren, who worked as a truck mechanic for Penske from June 2005 until July 2009, allegedly opened fire inside the facility just before 2 p.m. Jan 12, 2010, according to the AJC.

Jaider Felipe Marulanda, 43, of Lawrenceville; Robert Gonzalez, 31, of Dallas, Ga.; and Vance Springer, 59, of Woodstock, were killed in the shootings.

Two others, Joshua Holbrook of Cartersville and Zachariah Werner of Marietta, were injured, according to the Marietta Daily Journal.

Werner, who was left with a bullet lodged in his brain stem and is unable to function normally, filed a $20 million suit against business related to the Penske facility and Warren in June 2011, according to the MDJ. Holbrook and the widows of two of the men who died in the shooting also have filed suit.
