An Algonquin man has been charged with murder after prosecutors say he shot another man multiple times, killing him, during an argument along Metra tracks in Kane County.

Brian Hurtado, 20, of Algonquin, was charged with four counts of first-degree murder, aggravated unlawful use of a weapon and possession of a firearm by a street gang member. Prosecutors said Hurtado and the victim, Juan C. Ambriz, 26, of St. Charles, were engaged in an argument at a homeless encampment on the evening of November 11.

Hurtado pulled a handgun from the waistband of his pants and shot Ambriz multiple times, prosecutors said.

Ambriz was pronounced dead a short time later, prosecutors said.

“I want to thank the Illinois State Police for processing the crime scene, the Kane County Sheriff’s Office for its assistance in taking the defendant into custody and particularly the Elgin Police Department for going above and beyond in working with us, providing assistance with the investigation, as well as providing our detectives with space in the department to work during the investigation,” Metra Acting Chief of Police Patrick Gengler said.

Following his arrest, the Kane County State’s Attorney’s Office filed a petition to detain Hurtado pending trial.

A judge granted the petition and ordered Hurtado held in the Kane County Jail. Hurtado is scheduled to appear in court again on December 6.
