Zumba Lady Slipped on Wet Floor, Now Suing Bolingbrook Park District: Lawsuit

The woman tore a ligament in her ankle, the lawsuit said.

A Bolingbrook woman slipped on a wet floor while participating in a Zumba workout at the Annerino Community Center, according to a lawsuit filed in Will County court.

Kelly Elliott tore her anterior talofibular ligament in the February spill at the community center, the lawsuit said. She is suing the Bolingbrook Park District.

On the day in question, both entrances to the Zumba studio were closed “due in part to prior noise complaints,” the lawsuit said.

The lawsuit also claimed the community center’s ventilation system wasn’t working correctly and there was an “unnatural accumulation of moisture on the floor which was not readily visible to” Elliott.

Elliott slipped and fell, the lawsuit said, and because there was no one at the park district who could provide her “with any first aid whatsoever” she was “advised by an employee of the (park district) to go to the emergency room for assistance.”

The lawsuit does not mention if anyone else fell due to the alleged unnatural accumulation of moisture.

Park district workers were aware of the malfunctioning ventilation system and knew that closing the doors “would increase the humidity level in the room where the Zumba class was held,” the lawsuit said. They also allegedly knew of the unnatural accumulation of moisture on the floor.

Not only that, but after Elliott fell, the Zumba instructor “admitted to (her) and other class participants” that she recognized the danger and had sent an email to her boss warning of the risk, but the park district still “insisted that the doors to the class remain closed.”

Zumba is, “Pretty much the most awesome workout ever,” according to the website Zumba.com.

“Dance to great music, with great people,” the site said, “and burn a ton of calories without even realizing it.”
