Man Accused Of Punching Girlfriend, Her Daughter At Elgin Home

Prosecutors claim the man put the girl in a choke hold, punched and injured her, then threw a bottle at the child, and punched her mother.

KANE COUNTY, IL β€” A Berwyn man faces domestic battery charges stemming from accusations he injured his girlfriend and her daughter during an incident at the woman's Elgin home Saturday. Kane County State’s Attorney Joe McMahon approved several charges against Darius Fizer, 28, of the 1500 block of Grove Avenue, Berwyn, including felony aggravated battery to a child, misdemeanor domestic battery, two counts of misdemeanor battery and misdemeanor assault, according to a release from the Kane County State's Attorney's office.

Around 2:30 a.m. Saturday, Fizer placed a child younger than 13 in a choke hold, punched and injured her, then threw a bottle at the child, and punched her mother, Kane County prosecutors claim, according to the state's attorney's office.

According to Elgin police, Fizer and his girlfriend started arguing at his girlfriend’s Elgin home, waking her daughter. The daughter called 911 in fear of the argument escalating, according to the state's attorney's office.

The daughter then saw Fizer hit her mother, so she threw a pot at him, and Fizer threw a glass liquor bottle at the daughter, missing her and instead hitting the bathroom door, according to authorities. That's when Fizer then put the daughter in a choke hold and punched her, injuring her.

On Saturday, Kane County Judge Elizabeth Flood set Fizer’s bail at $50,000, with 10 percent ($5,000) to apply for bond, the state's attorney's office said. Fizer remains in custody at the Kane County jail, and his next court appearance is scheduled for Nov. 7 in Kane County.
