Lawsuit: Joliet Walmart Customer Needed Shoulder Surgery After Fall

Joliet resident Charles Welch has retained the law offices of Cassian & Carter to file this week's civil lawsuit against Walmart Stores.

JOLIET — Two years have passed since Joliet resident Charles Welch patronized the Walmart store at 2424 West Jefferson Street. As a direct result of his store visit, on April 30, 2022, Welch went ahead and contacted the Joliet law firm of Cassian & Carter to represent him.

This week, the Joliet lawyers went ahead and filed a civil lawsuit against Walmart, at the Will County Courthouse.

According to plaintiff's attorney William Cassian:

His client, Charles Welch, was inside the Walmart on West Jefferson Street two years ago this week "attempting to go to the checkout area of the store, his leg came into contact with a box containing soil and plants that was sticking out into the walkway, causing him to fall to the ground."

Welch's lawsuit indicates that when his leg came into contact with the Walmart store's planter and he fell to the ground, he suffered a shoulder injury and mental anguish and that caused medical expenses for his treatment, including surgery.

The Joliet lawsuit accuses the Joliet Walmart of being negligent and careless by failing to place the planters so that they did not protrude into the walking area, and so they would not be a tripping hazard and also for setting up the walkway to the checkout area in such a manner that the display became an obstacle and a tripping hazard.

The last line of the two-page lawsuit declares," Charles Welch demands judgment in his favor and against the defendant, Walmart Stores Inc. in an amount in excess of $50,000 plus costs of suit."
