Rapist Says Prison Employee ‘Forcibly Grabbed (His) Penis’

The rapist says he has asked the state's attorney and chief judge for help but has received no response.

CREST HILL, IL — A rapist locked up at Stateville Correctional Center claims he complained to the Will County State’s Attorney’s Office and the chief judge about a prison office worker grabbing his penis, but that they haven’t gotten back to him about it.

Damen Toy, a 51-year-old convict serving a 56-year prison sentence, filed a petition against the state’s attorney’s office, the state police and Stateville Warden Randy Pfister.

On Aug. 9, Toy was working as a legal clerk in the prison when he informed his supervisor that a Stateville employee “forcibly grabbed (his) penis through his pants without (his) consent,” the petition said.

The Stateville employee named in the petition was an office associate, according to a State Journal Register database.

The prison’s internal affairs division interviewed Toy, according to the petition, and he asked to speak with someone from the state’s attorney’s office and the state police so he could “file a formal criminal complaint” against the employee.

Toy was then placed in segregation and “denied proper access to a telephone,” making it impossible for him to call police or prosecutors, the petition said. Letters he wrote to the state’s attorney’s office and the chief judge have gone unanswered, according to the petition.

In June 2004, Toy raped a Chicago woman at gunpoint. He has also been convicted of armed robbery, forgery, drug possession and aggravated battery.
