His case is pending but they still want to take away his minivan.

JOLIET, IL — Prosecutors are trying to take an 11-year-old minivan away from a Peotone man facing a charge of driving while license revoked.
Adolfo Marquez, 33, was pulled over by a sheriff’s deputy near the corner of Harlem Avenue and Lincoln Highway on Aug. 1. He was talking on a cell phone while he was driving, according to a complaint for forfeiture filed in Will County court.
Marquez was arrested after a check revealed that his license had been revoked for driving under the influence, the complaint said.

Marquez is free on bond and his case remains pending. But even though Marquez has not been convicted of the crime, the state’s attorney’s office is trying to take away his 2005 Chevy Astro van, which is worth about $3,500, according to Kelley Blue Book.
An October court date was set for the state’s effort to take away the minivan.
