Oswego Man Learns Prison Sentence For 2021 DUI Crash That Killed 1

Oscar Cano was on his way back to Oswego after a Bears game, where he drank and did cocaine, when the fatal crash occurred, officials said.

OSWEGO, IL — An Oswego man found responsible for the death of a man in a 2021 car crash was sentenced to eight years in prison, Kendall County Sheriff Eric Weis announced Wednesday.

Oscar Cano, 38, was sentenced to eight years in the Illinois Department of Corrections for one count of aggravated driving under the influence involving death and a concurrent five years for one count of aggravated driving under the influence causing great bodily harm. He's required to serve 85 percent of the sentence.

The sentence stems from a crash on Nov. 21, 2021, as Cano, of the 400 block of Hackney Lane, returned from a Bears game with a friend, officials said. He was driving his Ford F-150 west on Millhurst Road when he blew a stop sign and crashed into a Chevrolet Silverado traveling northbound on Millington Road.

Both cars overturned into a field. Robert Gray, the 38-year-old Somonauk man driving the Silverado, was pronounced dead at the scene, Patch reported.

Cano and his passenger were ejected from the F-150 after the collision. The passenger suffered severe injuries and almost lost his eye, according to Weis.

"[He] endured a multitude of surgeries and continues in his recovery to this day," Weis wrote in a news release.

Deputies later interviewed Cano, who was also injured, at the hospital, where he admitted to alcohol and cocaine use. His blood alcohol content measured 0.176 at the hospital — more than two times the legal limit.

The Kendall County State's Attorney's Office approved charges against Cano and issued a warrant for his arrest three days later.

Cano was found guilty after a bench trial in March and has remained in custody since.

"The complexity of this case, with the amount of DNA evidence and expert testimony, caused lengthy delays in the pursuit of justice for the Gray and Foster families," Weis said in a statement. "I hope that after these long four years, they can find some closure. We wish Everette Foster the best in the future with his continued recovery and extend our deepest condolences to the Gray family for their loss."
