Inside Oak Village Part I - Foul-Mouthed, Ankle-Grabbing Ex-Con Bothers Bathers, Makes Racist Remark: Cops

He was drinking vodka, cursing up a storm, stole from a child and threatened her dad, according to a police report.

TINLEY PARK, IL — A drunken, foul-mouthed, racist ex-con grabbed the ankles of two women and filched a little girl’s swimming goggles, according to a police report.

Kevin Todd Leroy, 45, was charged with battery and assault in connection with his alleged June 11 antics at the Oak Village condos swimming pool.

Leroy started out his performance by showing up intoxicated and carrying a bottle of vodka to the pool, police said. He then allegedly grabbed a 56-year-old woman’s ankle “for no reason,” then drank more vodka.

The woman, Pamela Muth, told Leroy “that glass was not allowed at the pool and he told her to ‘f--- off,’” police said.

Leroy “had been swearing all day while at the pool, alarming and disturbing other residents who were using the pool,” according to a police report. Muth “said she did not call the police right away because she was/is scared of" him.

Other residents were also afraid of Leroy because he is on parole and has a gun, Muth reportedly told the cops.

Leroy was released from prison July 23, according to Department of Corrections records. He did time for unlawful restraint and aggravated driving under the influence convictions out of Will County.

A second woman, 46-year-old Maureen Bracken, reportedly told the cops that Leroy grabbed her ankle as well. Both women were able to provide cell phone photos that showed faint bruising to their ankles, police said.

The cops later spoke to a third resident, 34-year-old Brian Smagacz, who had been at the pool with his 9-year-old daughter.
“Smagacz said he heard (Leroy) being loud, ignorant, and swearing throughout the day,” according to a report. “Smagacz said the pool was full with other residents and children who were alarmed and disturbed by” Leroy, who at one point took Smagacz’s “9-year-old daughter’s goggles without her permission.”

A report said Smagacz requested Leroy return the goggles — and that he was given a disgustingly racist response.

“Smagacz then confronted (Leroy) and asked (him) to give back the goggles,” police said. Leroy replied, “I’m white, I don’t steal,” then “gave Smagacz a dirty look, jumped out of the pool, and was almost touching Smagacz’s face.”

Leroy then reportedly yelled, “I’m not scared of you — who do you think you are — I’m going to kick your ass,” a report said. “Smagacz backed off, saying he was not going to fight” Leroy, who walked away.

One of Leroy’s friends urged him to apologize, and he did so, Smagacz reportedly told the cops. Still, Smagacz recalled that Leroy “continued to be a ‘jagoff’ at the pool.”

The police reportedly went to Leroy’s home in the condo complex on Oak Park Avenue 10 days after the alleged incident. Leroy would not talk to them, police said, and he was placed under arrest.
