Tinley Restaurant Sued In Man's Death After Allergic Reaction

The lawsuit claims Hamada of Japan created an unsafe environment for the man who died after inhaling the steam from cooking seafood.

TINLEY PARK, IL — The company that owns a Japanese restaurant in Tinley Park faces a $50,000 wrongful death lawsuit by a woman who claims her husband died following an allergic reaction caused by an unsafe eating environment at the establishment. The complaint against Hamada of Japan, 8310 N. Creek Dr., was filed April 2 in Cook County Circuit Court, court records show.

According to the lawsuit, James O. Smith allegedly needed immediate medical attenion after inhaling allergens in the steam generated from seafood that was cooked at Hamada of Japan, the Cook County Record reports. An employee prepared the seafood near Smith despite the restaurant knowing of his allergies, the report stated. The lawsuit claims that the allergeic reaction Smith suffered eventually led to his death, the report added.

The lawsuit was filed by Smith's wife, Lynette, who is the special administrator for his estate, the report stated. The next court date in the case is set for May 31, according to circuit court records.
