Dwyer Pleads Guilty in Second Trial on Drunken Boating

The charge stems from an August 2012 crash on the Magothy River.

State Del. Don Dwyer pleaded guilty Tuesday in his second trial on a charge of operating a boat while under the influence of alcohol.

The Baltimore Sun reports the second trial, in Anne Arundel County Circuit Court, came as the result of an appeal of his sentence in district court. His original district court sentence included 30 days in jail, a fine and probation. His sentencing hearing in the new case is set for Oct. 25, according to the paper.

A prosecutor from Howard County—who is prosecuting the case because Dwyer is an Anne Arundel County elected official—told the Sun prosecutors will oppose probation before judgment but are not making any other recommendation.

The charge stemmed from an August 2012 crash on the Magothy River that injured seven. In a press conference outside the University of Maryland Medical Center, Dwyer admitted he was drinking at the time.

Dwyer, a Pasadena Republican, wrote in a January message to constituents that he had entered and completed an alcohol treatment program and that he was "committed to attending extensive aftercare counseling."
