Bella Bond Case: Attorneys Return to Court

At issue Tuesday: access to medical records.

BOSTON, MA — A Suffolk Superior Court Judge on Tuesday heard arguments from attorneys on each side of the case over toddler Bella Bond's death last year.

At issue Tuesday were different medical records sought by both sides.

The two-year-old's body washed up on Deer Island Beach last summer. Her mother's boyfriend, Michael McCarthy, was charged with murder three months later, accused of punching the little girl to death for being "unruly."

MassLive reports mother Rachelle Bond's attorney is trying to get hold of McCarthy's drug, medical and psychiatric records. Meanwhile, McCarthy's attorney wants to obtain Bond's drug and psychiatric records, in addition to records from the Department of Children and Families and the state Office of the Child Advocate, which MassLive reports has looked into DCF's handling of Rachelle Bond, "who previously lost custody of two earlier children."

Rachelle Bond has been indicted as an accessory after the fact of murder.

Both Bond and McCarthy have pleaded not guilty. Both are scheduled to return to court Nov. 10.
