Tom Brady to File Deflategate Appeal

According to the head of Tom Brady's legal team, the Patriots quarterback will appeal his suspension Monday.

Boston, MA - The head of Tom Brady's legal team said they will file an appeal Monday of the Patriots star's "deflategate" suspension.

in an interview with ABC , Theodore Olson, said Brady's legal team will file an appeal to the Second Circuit US Court of Appeals Monday.

That appeal will ask the court to reconsider its decision to suspend Brady for four games, as a result of the Deflategate controversy.

According to ABC, Brady will appeal en banc, asking the entire panel of the 2nd U.S. Circuit Court of Appeals to participate in the hearing. Seven of the 13 judges would have to agree before a hearing is held, making it a potentially tough sell.

The judges often take 4-6 weeks to decide if they should hear an appeal en banc, according to the Boston Globe.

This latest appeal comes about 16 months after the 2014 AFC Championship Game where allegations of ball deflation first appeared. An investigation into the matter known as the Wells Report determined that Brady was "more likely than not" aware that team equipment employees were deflating footballs below the legal limit of 12.5 psi.

Brady received a four-game suspension for his alleged role and the Patriots were fined $1 million and stripped of two draft picks.

Brady has denied any wrongdoing. After the suspension, he appealed the ruling to NFL Commissioner Roger Goodell, who upheld the suspension. In September, Judge Richard Berman vacated the suspension. The NFL promptly appealed the decision to the Second Circuit court in New York.

This year, the Second Circuit heard another appeal, this time by the league. The court ruled 2-1 in favor of the NFL and reinstated Brady's four-game suspension.
