JP Same-Sex Couple Sues for Federal Tax Refund

Universal Hub reported Friday that Vickie Henry and Claire Humphrey are suing because they're not allowed to file a tax return as a married couple.

A same-sex couple from Jamaica Plain wants their retroactive fair share under current rules for tax refunds.

Vickie Henry and Claire Humphrey sued the IRS Thursday, asking for a tax return as a married couple for years 2007 and 2009, according to Universal Hub.

The couple filed amended returns for those years at the lower “married” rate as opposed to the rate at which single people are taxed, the website reports.

In 2012, the US Court of Appeals ruled Defense of Marriage act, which defined the term “married” on tax statements, was unconstitutional.

Henry and Humphrey have been married since 2004, Universal Hub reports.
