1:25 a.m. Sgt. Carrasquillo was assisting Officer Fritts with a disabled motor vehicle on Worcester Street near Cliff Road when he observed a Jeep pass his location at a speed greater than the posted speed limit. As the vehicle passed him, he noticed that the roof and doors were off of the Jeep and the music being played was extremely loud. He stopped the vehicle on Worcester Street near Audubon Road and spoke with the operator, 29-year-old Allan Burke of Natick. While speaking with Burke, he noticed that his eyes were bloodshot and glassy, there was a strong odor of an alcoholic beverage emanating from his person and he admitted to consuming alcohol. Burke agreed to take some reasonable tests of balance and coordination to determine his ability to safely operate a motor vehicle. He took four tests and after observing his performance on the tests, Sgt. Carraquillo believed that Burke was unable to safely operate a motor vehicle due to intoxication. Burke was taken into custody, charged with operating under the influence of liquor, negligent operation of a motor vehicle, and a harsh and objectionable noise bylaw offence, transported to the station, booked in the usual manner, afforded all rights and later released on personal recognizance.
