At 11 p.m. on April 5, while traveling on Maugus Avenue, Officer Derby saw a vehicle off the road. The white BMW sedan seemed to crossed the road into oncoming traffic, and collided with a fence and trees. The vehicle was on its side in the woods.
The driver was speaking with paramedics when the officer arrived. He refused medical attention, but Derby noted he appeared to be unsteady on his feet. When he spoke with the driver, he also noted a smell of alcohol about the person.
The driver said he was trying to get an item from inside his vehicle and lost control of his car. After taking and failing two field sobriety tests, police arrested and charged Ricardo Rodriguez, 38, of Dunedin street, with operating under the influence of alcohol and failing to drive in the right lane.
He was transported and booked at the Police Station, and was later released under personal recognizance.
