These 35 Officers Won't Be Called To Testify Due to Past Untruths

Wayne County prosecutors released a list of 35 police officers who have a history of providing false statements, bribery or bias.

WAYNE COUNTY, MI — The Wayne County Prosecutors Office on Thursday released a list of 35 current and former police officers who have committed offenses spelled out in the Giglio case for offenses involving theft, dishonesty, fraud, providing false statements, bias or bribery.

Wayne County Prosecuting Attorney Kym Worthy said she reached out to local police chiefs, the Wayne County Sheriff's Office, Michigan State Police and federal agencies to make the list, adding that the offenses can be considered at trial.

"Because trials will begin again mid-August and September, we thought it was important to send this out to our prosecutors and defense attorneys," Worthy said. "There are currently 35 officers on the list. We are taking the additional step of releasing the list to the public, because in an era of criminal justice reform, it just makes sense. We will repeat this process quarterly and expect to release an updated list in September."

Worthy decision to release the names comes at a time when calls have been made for added police transparency following the death of George Floyd, a black man killed with a police officer's knee on his neck while in custody in Minneapolis.

The Giglio case refers to Giglio v. United States, a U.S. Supreme Court case that granted a man a new trial because prosecutors did not tell his defense counsel about an agreement not to prosecute a witness in exchange for testimony.

Officers who have been found guilty of lying and similar crimes are considered "Giglio-impaired." Prosecutors are required to tell defense attorneys if any officer involved in their respective case have backgrounds of providing untruths.

Of the 35 officers included in the list, which was obtained by Patch, 28 work or worked at the Detroit Police Department.

Patch has reached out to the department for comment.
