Hundreds Of Drivers Receive Summonses For Violating Move-Over Law: New Hampshire State Police Roundup

CONCORD, NH — New Hampshire State Police spent a week earlier this month and late last month enforcing the move-over law and, in the process, issued 407 summonses.

Between Oct. 26 and Nov. 2, troopers conducted “targeted patrols” focused solely on Sherrill’s Law violations across the state. The law is named after fallen State Police Staff Sgt. Jesse Sherrill, who was killed during a crash on Oct. 28. The enforcement was also performed on the fourth anniversary of his death, in an effort to raise awareness and ensure compliance with the law.

Violators face a $75 fine plus a penalty assessment for the first offense and a $250 fine plus a penalty assessment for subsequent offenses within 12 months, state police said.

“When approaching an incident involving a fire, collision, utility work, or any emergency that results in a partial or full blockage of the roadway, or when approaching a stopped vehicle displaying warning signals, Sherrill’s Law requires drivers to slow down and give plenty of space to public safety personnel and others in the roadway,” state police said. “Drivers are also required to move out of partially or wholly blocked lanes when it's safe to do so.”

State police urged all drivers to slow down and move over if they see flashing lights ahead. Whether it is a law enforcement officer, firefighter, EMT, tow truck operator, highway worker, or someone whose car has broken down — “their safety depends on others’ close attention and prompt action.”

NH Sex Offender Arrested In North Carolina

A sex offender from Rochester has been arrested in North Carolina, accused of failure to register.

Gary Dean, 65, was convicted of aggravated felonious sexual assault and robbery in 1985 and received a 30-year sentence.

In 2017, after being released from the New Hampshire State Prison for Men, he began to be registered as a sex offender. In 2022, he was accused of failing to register in Rochester and moved to High Point, NC. State police also accused him of failing to register in North Carolina. A warrant for his arrest was issued in March.

Dean was arrested in North Carolina and held on a fugitive-from-justice warrant. He was waived extradition and was brought to New Hampshire. Dean faces six felony counts of duty to report. He was arraigned in Rochester District Court on Nov. 6.

Maine Woman Accused Of Drunken Driving At 100+ MPH

A woman from Maine was arrested last month on drunken driving and speeding charges, accused of driving more than 100 mph in Ossipee.

At around 10:30 p.m. on Oct. 8, state police dispatch received reports about a vehicle traveling at high speeds on the westbound side of Route 25. The driver, Alisha Bernice Timmons, 36, of Portland, ME, was accused of driving 107 mph in a 55 zone.

“During the traffic stop,” a report stated, “Timmons showed signs of impairment and was ultimately taken into custody. She was transported to the Carroll County House of Corrections to be processed.”

Timmons was arrested on aggravated driving while intoxicated, resisting arrest, criminal mischief, breach of bail, and open container charges. She was held on preventive detention and arraigned on Oct. 9.
