• Contradictory statements made by DTC attorneys in multiple tribunals,
• A Superior Court transcript showing the Newmarket Town Council approved a settlement by email vote,
• Missing minutes required by RSA 91-A,
• Evidence of violations of RSA 641:3, RSA 641:7, RSA 91-A, and RSA 626:8,

Assistant Attorney General Thomas Velardi responded with a one-sentence dismissal and declared:

“The DOJ stands by its decision… You have not raised an articulable suspicion.”

This is not laziness.
This is not misunderstanding.
This is active protection of government misconduct.

Velardi is refusing to do the very job he is paid to do.
Worse — his refusal is enabling ongoing misconduct by multiple officials.

1. ASSISTANT ATTORNEY GENERAL THOMAS VELARDI

• Refused to investigate despite overwhelming evidence.
• Ignored contradictory filings by DTC attorneys.
• Ignored a falsified public record created by Newmarket.
• Ignored the Town Council’s illegal email voting process.
• Issued a DOJ letter claiming “no crimes occurred” WITHOUT reviewing the full record.
• Refused to correct his false determination even after evidence was shown to him.
• Allowed Newmarket and DTC to weaponize his defective letter to pursue sanctions and attorney fees.
• Is now the subject of a criminal and ethics complaint for:
  • Maintaining a false public record (RSA 641:7)
  • False statements in an official matter (RSA 641:3)
  • Aiding and abetting unlawful conduct (RSA 626:8)
  • Violations of Rules 4.1, 8.4(c), 8.4(d)

Velardi is no longer an investigator.
He is now part of the misconduct being investigated.

2. STEVE FOURNIER – Town Manager, Newmarket

• Authored the falsified August 28, 2023 public document.
• Misrepresented the Town Council’s approval process.
• Failed to provide legally required minutes under RSA 91-A.

3. JOHN RATIGAN – Attorney, DTC

• Gave contradictory statements to the Ombudsman, Superior Court, and Supreme Court.
• Later admitted the settlement was approved via email exchanges, contradicting earlier statements.

4. CHRISTOPHER HAWKINS – Attorney, DTC

• Claimed no public records existed even though emails did exist.
• Used Velardi’s false determination as justification to pursue sanctions.

5. WILLIAM WARREN – Attorney, DTC

• Participated in filings containing false or misleading statements.
• Repeated narratives later contradicted by the transcript.

6. BRIANA MATUSZKO – Attorney, DTC

• Contributed to filings containing contradictions.
• Supported Newmarket’s false factual narrative.

7. THE NEWMARKET TOWN COUNCIL (Collectively)

• Approved the settlement agreement through email voting, which is a “meeting” under RSA 91-A.
• Failed to create mandatory minutes, violating RSA 91-A:2, II.
• Allowed Fournier to issue a false public document misrepresenting their actions.
