Trial for Man Accused of Christmas Spit Attack

Roy Fontes allegedly threatened to beat up police after making "unprivileged physical contact" with another man.

A Hampton resident has been indicted on two different charges stemming from a Christmas Day 2012 altercation in Exeter that ended with him threatening police.

Roy M. Fontes, 35, of 19 M St., Apt. 4, in Hampton, has been indicted in Rockingham Superior Court on one count of criminal threatening and one count of simple assault for his actions during an incident at .

Fontes' simple assault charge, a Class B misdemeanor, stems from allegedly causing "unprivileged physical contact" with another man by "spitting on his neck and arm," according to the indictment.

Fontes faces a Class B misdemeanor criminal threating misdemeanor for threatening two Exeter police officers during the incident, allegedly telling them. "I'm going to kick your [expletives]." The indictment also states that Fontes placed the officers "in fear of imminent physical contact" due to his "aggressive posture."

Fontes' bail was set at $2,000 following his Dec. 25, 2012, arrest.
